Guest / Renter Obligation: a. The Renter shall ensure that they arrive at the Holiday home at the allocated time, unless notified 1st party about any delay. b. Only those persons appearing on the Booking Form shall occupy the Holiday homes and number of persons must not exceed the number of sleeping places indicated on the Booking Form or Website. c. The amount of deposit shall be refunded after 24 hours after guest checks out to the Renter, after carrying an inventory check list on the Holiday homes by the Agent who has the right to deduct any payments in case of losses or damages to the Holiday home and furniture upon check out. d. The Renter shall be entitled to occupy the Holiday homes as of the commencement date mentioned and time herein and shall evacuate the Holiday home at the last date of the Rent should no extension be made in advance and approved by writing by the first party- e. The Renter shall comply with all rules and regulations applicable in the UAE at any time and the community laws. ln the event that the Renter wishes to vacate the Holiday home before the ending date the Renter will not be entitled to any refund except for security deposit. f. The Renter shall insure having and obtaining all legal documents during his/her stay in the Holiday home and shall obtain the required insured policies including accidents during his stay in the Holiday home. g. The Renter shall refrain from committing any illegal act or similar acts that may lead to police or other authority interference and shall take all precautions in all security and legal measurements. h. The Renter shall not make any changes to the Holiday homes and shall maintain the assets and all equipment available in good shape. i. The Renter shall not, under any circumstances and during the term of this Agreement, assign this Agreement or sub-let the Holiday home to any 3rd party, if any assignment or sub-letting occur this Agreement shall be considered null or void and instantly terminated. j. Use of Holiday home: The use of the Holiday homes shall only be for residential purpose. lf any part of the Holiday home is used by the Renter for carrying on any business shall be considered as a breach of the Agreement with the right for the company to evacuate the Renter instantly. lf community rules are not been followed by the guest, the agent has a right to evacuate the Renter instantly without any REFUND. k. Loss of Access / parking card will be charged 500 AED/card and loss of key will be 100 AED/key. l. Smoking inside the apartment is not allowed. lf found smoking, there will be a fine of 1000 AED. m. Guest should inform the company about the PET. The company has right to decide whether to allow the PET to stay . There will be a PET FEE cleaning charges of 550 AED. n. The company has right to enter the apartment/villa if the guest is staying without paying his/her rent. ln such case the company or representative will not be responsible for any loss of guest belongings inside the rented apartment/villa o. No extension of the apartment will be accepted without the payment. The company has all right to evacuate the Renter anytime of the day if the payment is not paid. p. lf the security deposit receipt is lost the guest will not get the security deposit at the time of check out. Guest has to come to office and sign the refund document from our accounts department. q. Adjustment: The Renter shall refrain from making any alterations inside/outside the Holiday home and undertakes not to remove any fixed construction such as electric wirings, water pipes, and sanitary installations. r. Renter Acknowledgement: The Renter acknowledges that it has checked the condition of the Holiday home and accepted it as is & holds the Agent harmless of any claim or indemnification in any case related to the condition & situation of the Holiday home. s. Hazardous Materials: Renter shall not keep in the Holiday home any item of a dangerous, flammable or explosive character that might unreasonably increase the danger of fire or explosion in the Holiday home or that might be considered hazardous by any responsible insurance Agent. t. Vacant- Termination: lf the Renter wish to vacate the Holiday home before the term lease Agreement, he needs to notify the Agent in writing before his departure in order to check the condition of the Holiday home with the Agent according to the inventory as per conditions. All reservations are Non-Refundable. lf the renter has to cancel the agreement accepted by both the parties ,the renter will have to pay 2 weeks as cancellation fee. lf the Renter leaves without notifying the Agent, the latter shall have the right to open the premises in his capacity as the legal representative of the Holiday home and to use it freely without any prior notification and to lease it to other Renter he finds suitable. New Arabian: The Agent a. Shall not be responsible for any service that do not form part of this Agreement i.e. any other services supplied by outside Contractors. b. The agent will use its best endeavors to provide such changes to their Booking as are required by the Renters, if for any case the agent needs to vacant the apartment,the renter will be given 7 days notice or will be offered a similar apartment in the same area. c. The agent shall use its best endeavor to ensure the Renter do occupy the Holiday home for which they booked but in the event of either Force Majeure or any other such emergency, the Agent shall use its best endeavor to provide the Renters with an alternative Holiday home of equal or superior quality. d. The Agent/owner will use all reasonable skill and care in performing and providing its service to the Renters but shall not be responsible for any injury illness, death, loss, damage or claim of whatsoever nature which may result from either of the following: . Fault of person(s) affected or any member(s) of their party . Fault of a third party no connected with the provision of the accommodation by the Agent which the Agent could not have predicted or avoided. . An event or circumstance, which could not have been predicted or avoided even after taking all reasonable care and skill. e. The Agent ensure the Renter is introduces to the service provided with the Holiday home and that they are instructed in the use of the electrical and gas appliances. f. Services and maintenance: The Agent shall insure the term of this Agreement to provide at its sole expense utility bills (electricity, water, gas air conditioning system, television, channels, and internet connection)
